Where can I find information about motion hearing date reservations?

Motions can be reserved by calling the Law & Motion department. If a motion is submitted without a hearing date, Calendar clerks assign the hearing date based on availability once the motion is processed. Please allow us time to set these hearings. When the hearing is set you will be able to view it in your case on: Superior Court-Case Information PortalOnce the hearing date is assigned, please send an amended notice.

Where can I find information about scheduling a MSC hearing?

At this time MSC hearings generally are held remotely. If a party wants an in-person hearing, it can ask for one. The settlement attorney or judge will reach out to the parties to schedule a hearing.

Where can I find information about my trial appointment?

Trial department assignments are made Thursday before the Monday trial. Court staff will notify you, the trial judge, and department on Thursday or Friday before the trial. The details of an in-person appearance may be arranged with the trial department.

How do I submit files?

It is mandatory for attorney-represented cases to eFile their documents. Pro per litigants may submit their filings by mail, and/or use the drop-box to drop off their filings. All documents will be filed and processed in the order it is received. The file date of each filing will be the date that it was submitted in an eFile, dropped in the drop-box, or mail was received by the court.

What information do I need to know about attaining a copy of a document related to my case?

Copies of the documents in a Civil/Small Claims/Probate case may be obtained at the courthouse in which the case was filed by mailing a request with a self-addressed stamped envelope to return the documents. A fee of $0.50 per page will be charged. There is a fee of $40 to certify a document. There is a fee of $50 to exemplify a document.

Please include the case number, case title, title of the documents requested and the dates the documents were filed when you submit your request. Case numbers for files after 1996 are available from the court’s public access website. Copy requests of more than 25 pages may take up to 30 working days to complete. If you are unable to provide all these items, a search fee of $15.00 will be charged.

To obtain copies when you do not know the number of pages, please submit a check “Not to Exceed” with an amount with which you are comfortable. Complete the check as far as the date, make payable to the Superior Court, sign the check, write the case number on the check and below the line where you write out the amount, write “Not to Exceed $ 10” which would cover up to 20 pages. Your copies and receipt will be returned to you in your self-addressed stamped envelope. Please mail to the following address: Superior Court Civil Division 191 N. First Street San Jose, Ca 95113.
